How we use your information in this consultation.

This notice explains what personal information we collect when you take part in the Summerhall public consultation, why we collect it, how we look after it, and your rights.
1.Who we are
This consultation is run by Calton Planning and Development Ltd (company number SC734774) on behalf of the applicant, AMA (New Town) Limited. Calton Planning and Development Ltd is the data controller for the personal information collected through this consultation. This means we decide how and why it is used, and we are responsible for looking after it.

2.What information we collect
When you send us feedback, we collect:
- Your name (required). We ask for your name so the project team can see that responses come from real individuals, avoid counting the same response twice, and reply to you where needed.
- Your email address (optional). Only if you choose to give it.
- Your answers to the consultation questions.
- The date and time you submitted your feedback.
Our web host, IONOS, also keeps technical server logs for security purposes, such as your IP address and browser type.
3.Why we use it
We use your information to:
- run this pre-application public consultation;
- consider your feedback when developing the proposals for Summerhall;
- prepare the Pre-Application Consultation Report for The City of Edinburgh Council; and
- reply to you, if you gave us your email address.
4.Our lawful basis
We rely on legitimate interests. Consulting the local community before a planning application is submitted, and reporting on that consultation to the Council, is an expected and necessary part of the planning process. We only use your information for that purpose, and we have balanced this against your rights and interests.
5.Sensitive information
Please don't include sensitive personal information in your answers, for example information about your health. If you do include it, we will only use it for the purposes of this consultation.
6.Who sees your information
Your responses are seen only by the project team: Calton Planning and Development Ltd and AMA (New Town) Limited. They are stored on servers provided by our web host, IONOS.
We do not sell your information and we do not publish it. The report we submit to the Council summarises the comments received; it does not include your name or email address.
7.How long we keep it
We keep full responses until 6 months after the Council makes its decision on the planning application. After that, names and email addresses are deleted, and only anonymised answers are kept as the record of the consultation.
8.Paper forms and the drop-in event
This notice also covers paper feedback forms and any comments you give us in person at the public consultation drop-in event. We handle that information in the same way as feedback sent through this website.
9.Your rights
You have the right to:
- ask for a copy of the information we hold about you (access);
- ask us to correct information that is wrong (correction);
- ask us to delete your information (deletion);
- ask us to limit how we use it (restriction); and
- object to us using it (objection).

10.Complaints
If you are unhappy with how we have handled your information, please email info@summerhallconsultation.co.uk. We will acknowledge your complaint within 30 days, look into it, and tell you the outcome.

We may update this notice from time to time. The date at the top of this page shows when it was last updated.
